BMW halts plan to use temps 'get out' clause

The luxury car manufacturer said it has entered into negotiations with unions about its future use of agency staff after new rules giving temps extra rights after 12 weeks in a job were introduced.

The company had intended to use the so-called "Swedish derogation" model to avoid having to pay temps the same as permanent staff, but has decided to put these plans on hold while talks with unions are ongoing.

Large employers including Jaguar Land Rover, Tesco, Premier Foods, Carlsberg and Morrisons all admitted last year that they were in talks with their recruiters about using the model.

A BMW statement said: "The company and Unite, the union, have jointly agreed to enter into discussions relating to the use of agency staff. While these discussions are ongoing the company will not proceed with its plan to use regulation 10 of the Agency Workers Regulations [the Swedish derogation]."

The derogation model is an effective get-out clause, contained within the new agency law, which allows recruitment agencies to employ temps directly and contract them out to organisations.
